Maybach and Smart are pretty worthless in profit.

Trademark matters every bit! It is company asset! It does not matter what the history of the name is. Trademark can be bought and sold and can expire due to non-use as well. Unless you follow all the rules, it is hard to obtain right to a name in multiple countries. In the U.S., Ford owns the right to the Daimler mark in the automobile industry. Sure, you can make an argument that calling a company “Daimler” vs. a model name or trim name is not the same, but the bottom line remains if it will create confusion to the average consumer.

A few years ago, Ford lost the case to use “Futura” to a tire company. Therefore, we have the Fusion now. This is an example of the broad mark protection. Tire and model name, who would have ever confuse them? But the court disagreed. So I doubt Daimler-Benz would be able to use the name Daimler without Ford’s permission.

And the top trim of a Jaguar is Vanden Plas, not Vandas Plas. It was the name of another company in Belgium.

Oh yea, I remember that neko. But it shouldn’t matter anyway – in this case its the name of a company whereas Ford only uses the Daimler name as the highest trim level on Jaguar XJs in some markets. In America though, they have stopped using Daimler and now use Vandes Plas or something.

Benz, Daimler, and Maybach were the founders of Mercedes pretty much. Mercedes Benz and Maybach are already nameplates, as long as Daimler doesn’t become a nameplate there should be no dispute here

Daimler Benz was one of the first car companies after merger between Daimler and Benz. It is difficult to copyright name especially the one which was used in the same industry first.

Daimler AG: such a short little name. At least Kia Motors ends with Motors. Also, you’ve got a point there, Commodore. Ford should do something: Ford should sue Daimler for the Daimler name infringement too.

I can never understand why the Benz name was dropped except for the fact it would be too long with “Chrysler” in the company name when they merged.

In China and Hong Kong, Mercedes are known as Benz after the phonetic translation.
