It&#039;s not a big deal. People don&#039;t look out for hot exhaust pipes from a Mini. For that matter, unusually, defective hot tail pipes. Sometimes people rub against things accidentally. It&#039;s not like their sticking their feet underneath there. How many times have you accidentally dropped a wrench in the garage because you brushed against the table? Or spilled your coffee cup accidentally? It&#039;s not something that happens because your not being careful, just being unaware. And the fix is so simple- their taking off a freaking exhaust extender. A piece that cost a dollar, that&#039;ll just save BMW a buck or two later.

I tried to grip a tail pipe of a VW bug when I was four. Dumb? Maybe. But I never did it again. I never cried about it nor told my parents, just ran my hand under some water until it stopped hurting. No, I didn&#039;t burn my hand. If I did grip that pipe I might have.

The tailpipes on a MINI Cooper are not too long. The Trial judges are too lenient to even hear stuff like this. This car has been out of at least four years and it took till now, when every one seems to be going broke, to bring this up.

		<description>Lawyers and Judges are just trying to make an honest (cough) living; just trying to eke by like the rest of us..  at an out-of-school starting wage of $80,000-$100,000 minimum!  Nice &quot;starting&quot; salary, most people that work for 20 years don&#039;t make that in architecture.  It&#039;s my own fault, I could have chosen to be an attorney if I wanted to I guess.  I can&#039;t really blame them, money is a powerful, addicting thing.  But, are the exhaust tips really THAT hot?  The ones on my TT aren&#039;t hot enough to really burn a person if you touched them.</description>

You are presupposing that people touch the tail pipe purposely.  What the NHTSA is protecting is inadvertent contact with the tail pipes.  Have you considered why this recall ONLY affects 2007-09 Mini Cooper S, and not other cars?  That suggests that this is indeed a design flaw, and not stupidity, unless you have some statistics of Mini buyer being more stupid than Camry buyers, etc.
